The machine, accessories, options, freight arrangements and other items included in your purchase are those stated in your accepted quotation, invoice or written order confirmation.

Website builders, photographs, videos, 3D models, specifications and pricing are provided to help customers understand our products. Optional equipment shown in photographs, videos or demonstrations is not included unless specifically stated in your order.

Turbosawmill continually develops its products and may make reasonable engineering or component changes during production provided those changes do not materially reduce the agreed function of the machine.

Customers purchasing replacement parts or upgrades are responsible for providing the correct sawmill model and serial number where requested so that compatibility can be confirmed.

Turbosawmill provides extensive information to allow customers to understand its products before purchasing, including specifications, photographs, operating videos, demonstrations, manuals, interactive 3D models and direct access to our sales and support team.

It is the buyer's responsibility to review this information, ask questions and satisfy themselves that the selected machine, configuration and options are suitable for their intended use before placing an order.

Statements made in videos, demonstrations, customer examples, calculators, testimonials or marketing material illustrate what may be achievable in particular circumstances. They are not a guarantee that another customer will achieve the same result.

Turbosawmill does not guarantee any particular production rate, daily output, timber recovery, financial return, income, profit, payback period or business result.

Sawmilling results are affected by factors including:

• operator experience and proficiency;
• machine setup and adjustment;
• log size, species, shape and condition;
• blade condition and sharpening;
• feed speed and cutting technique;
• maintenance;
• site conditions and material handling;
• customer workflow and labour;
• local markets and timber values; and
• many other circumstances outside Turbosawmill's control.

Customers should expect a learning period while becoming familiar and proficient with their machine.

Any manufacturing, dispatch, vessel, transit or delivery date supplied by Turbosawmill is an estimate only unless Turbosawmill expressly agrees otherwise in writing.

International machinery shipments involve manufacturers, freight forwarders, shipping lines, ports, customs authorities, trucking companies and other third parties. Weather, port congestion, customs inspections, vessel changes, industrial action, equipment failure, border requirements and other unexpected events may cause delays.

Turbosawmill does not guarantee an arrival date and, to the maximum extent permitted by law, is not liable for loss of income, production, contracts, opportunity or other consequential loss caused by a delay outside Turbosawmill's reasonable control.

Freight, insurance, duties, tariffs, taxes, customs clearance and delivery responsibilities will be as stated in the customer's quotation or invoice.

Customers should not make time-critical commercial commitments based solely on an estimated machine arrival date.

Turbosawmill machines are large industrial products manufactured, configured, packed and shipped internationally. They cannot practically be treated as ordinary retail return items.

Before dispatch

Any request to cancel or change an order after Turbosawmill has begun purchasing components, manufacturing, configuring, allocating stock or arranging freight is subject to Turbosawmill's written approval. Turbosawmill may deduct reasonable costs already incurred as a result of the order.

After dispatch

This is particularly important for international orders because the machine may have travelled thousands of kilometres, incurred international freight and import costs, and may have been assembled or used after delivery.

This clause does not remove any remedy that Turbosawmill is legally required to provide for a genuine defect or other right that cannot lawfully be excluded.

Turbosawmill warrants its machines against defects in materials and workmanship for the warranty period stated for the relevant machine at the time of purchase.

At the date these terms were published, the current standard warranty advertised by Turbosawmill is:

• M7 PowerSaw — one-year warranty on the mill framework.
• M10 and M12 — two-year warranty on the mill framework and Turbosawmill-supplied motor/engine.

The warranty applicable to an individual purchase is the warranty confirmed on the product page, quotation or order documentation at the time of purchase.

Engine and motor claims

A customer may be required to have an engine or motor fault inspected or diagnosed by an authorised or suitably qualified service provider. Turbosawmill must approve warranty work before outside labour or repair costs are incurred.

Industrial workmanship

Turbosawmills are working industrial machines. Minor cosmetic marks, weld appearance, surface variation, paint or coating variation, machining marks, packaging marks or other cosmetic differences that do not materially affect the safe operation or function of the machine are not regarded as manufacturing defects.

Where Turbosawmill confirms a valid warranty fault, Turbosawmill will determine the appropriate remedy, which may include supplying a replacement component, repairing a component or another reasonable remedy, subject always to rights that cannot legally be excluded.

Unless required by law or specifically agreed in writing, warranty does not cover problems caused by:

• normal wear and tear;
• blades, blade tips, belts, ropes, pads and other consumable or wear items;
• incorrect setup or adjustment;
• operator error or lack of maintenance;
• misuse, abuse or accident;
• unauthorised modification or repair;
• incorrect sharpening or blade maintenance;
• operation outside the instructions supplied by Turbosawmill;
• damage occurring after delivery;
• customer-supplied equipment, including a chainsaw used with an M7;
• ordinary corrosion, weathering or deterioration caused by storage or exposure; or
• commercial results or production expectations.

Customers must contact Turbosawmill before authorising third-party warranty repairs. Turbosawmill is not responsible for unauthorised labour, travel, accommodation or repair costs unless agreed in writing beforehand.

The customer is responsible for ensuring that the sawmill is assembled, operated, maintained and used safely and in accordance with the instructions provided.

The owner is responsible for operator training, appropriate protective equipment, workplace procedures, site safety and compliance with applicable laws and regulations in the country or region where the machine is used.

To the maximum extent permitted by law, Turbosawmill is not liable for indirect, incidental or consequential loss including loss of profit, income, production, contracts, opportunity or business resulting from use of the machine, inability to use the machine, freight delays or matters outside Turbosawmill's reasonable control.

To the maximum extent permitted by law, Turbosawmill's total liability arising from a product will not exceed the amount paid to Turbosawmill for the affected product.

Nothing in these terms excludes or limits liability or customer rights where doing so would be prohibited by applicable law.

These terms and any sale by Turbosawmill Ltd are governed by the laws of New Zealand unless otherwise agreed in writing.

Where a customer acquires goods in trade for business purposes, Turbosawmill intends, where legally permitted and where the applicable statutory requirements are satisfied, that the Consumer Guarantees Act 1993 will not apply to that business transaction.

Nothing in these terms is intended to exclude rights that cannot lawfully be excluded under the Consumer Guarantees Act, Fair Trading Act or other applicable law.

No statement by an employee, dealer, distributor, agent, video, advertisement or other communication changes these terms or the agreed specification of an order unless the change is confirmed by Turbosawmill in writing.

If any provision of these terms is found to be unenforceable, the remaining provisions continue to apply.
